These Terms of Use (“Terms”) govern the access and use of Doxmate, a healthcare-focused AI appointment automation platform operated by Brainox Tech (“we”, “our”, “us”). By accessing or using Doxmate—including our embedded signup, dashboard, WhatsApp-based appointment system, or any related services—you (“user”, “clinic”, “hospital”, “you”) agree to these Terms.

If you do not agree, you must not use Doxmate.

1. Eligibility

To use Doxmate, you must:

• Be at least 18 years old

• Be authorized to represent a healthcare organization

• Provide accurate information during signup

• Accept these Terms and all related policies

When signing up via Embedded Signup, you certify you have authority to bind your clinic/hospital to this agreement.

2. Services Provided

Doxmate provides:

• AI-powered appointment booking & rescheduling

• Automated WhatsApp reminders & confirmations

• Admin dashboards for managing schedules & staff

• Appointment workflow tools

Doxmate does NOT provide:

• Medical advice

• Diagnosis

• Treatment

• Clinical decision-making

It is strictly an administrative automation platform.

3. User Responsibilities

You agree to:

• Provide accurate patient & clinic information

• Maintain confidentiality of login credentials

• Use Doxmate only for lawful, administrative scheduling

• Obtain patient consent where required

• Ensure staff use the platform responsibly

You must NOT:

• Send marketing/promotional/bulk WhatsApp messages

• Upload sensitive medical data (diagnoses, lab results, prescriptions)

• Violate WhatsApp or Meta’s Business Messaging Policies

• Reverse-engineer, hack, or misuse the platform

• Use Doxmate outside healthcare-related purposes

Violation may lead to immediate termination.

4. WhatsApp Cloud API Requirements

Doxmate relies on WhatsApp Cloud API (Meta). All users must comply with:

• Meta Business Terms

• WhatsApp Business Messaging Policy

• WhatsApp Opt-In Rules (where applicable)

Doxmate may suspend or restrict access if:

• WhatsApp/Meta restricts your WABA

• You violate Meta’s communication policies

5. Patient Data, Privacy & Data Handling

By using Doxmate, you acknowledge:

• Clinics/hospitals are the data controllers

• Doxmate (Brainox Tech) acts as the data processor

• Clinics are responsible for lawful collection of patient data

• Doxmate uses encrypted, secure AWS infrastructure

• Doxmate does not store clinical medical records

Data Sale Restriction:
We do not sell, trade, or monetize personal data.

6. Payments & Subscriptions

• Subscription fees may be monthly, yearly, or enterprise-custom

• Fees are due at the start of each billing cycle

• Failure to pay may cause service suspension

• Refunds & cancellations follow the Refund & Cancellation Policy

7. Intellectual Property

All Doxmate AI tools, dashboards, workflows, software, and content are owned by Brainox Tech.

You may NOT:

• Copy

• Modify

• Reverse-engineer

• Resell

• Build competing services from Doxmate technology

You receive a limited, non-transferable license for your clinic’s internal use.

8. AI Disclaimer

Doxmate uses AI to interpret administrative messages and automate scheduling.

You acknowledge:

• AI outputs are not medical advice

• AI-generated text is for administrative purposes only

• Clinics remain fully responsible for reviewing AI actions

• AI cannot make clinical or emergency decisions

Clinics accept all responsibility for clinical judgment and patient care.

9. Third-Party Services

Doxmate relies on:

• Meta / WhatsApp Cloud API

• Amazon Web Services (AWS)

• Payment processors (Stripe/Razorpay)

• Analytics tools

We are not liable for interruptions or restrictions caused by these third parties.

10. Service Availability

Doxmate is provided “as-is” and “as-available”.

We do not guarantee:

• Uninterrupted service

• Error-free performance

• 100% uptime

Downtime due to AWS, Meta/WhatsApp, telecom networks, or internet failures does not constitute breach.

11. Limitation of Liability

Doxmate / Brainox Tech is NOT liable for:

• Medical outcomes

• Missed or incorrect appointments

• Patient no-shows

• WhatsApp delivery failures

• Third-party outages

• Loss of revenue or business interruption

Maximum liability is limited to the amount paid in the previous 3 months.

12. Indemnification

You agree to indemnify and hold harmless Brainox Tech (Doxmate) from any claims, damages, or losses arising from:

• Violation of WhatsApp/Meta policies

• Uploading prohibited or sensitive medical data

• Illegal or unauthorized messaging

• Misuse of patient data

• Breach of these Terms

• Misuse by your staff or team members

13. Prohibited Uses

You may NOT use Doxmate for:

• Spam or marketing blasts

• Non-healthcare-related messaging

• Clinical diagnosis or medical interpretation

• Illegal or fraudulent activities

• System attacks or disruptions

Violations may result in immediate suspension without refund.

14. HIPAA & International Compliance

Doxmate is not a HIPAA-covered entity.
Clinics using Doxmate in HIPAA jurisdictions must ensure:

• They are compliant

• They do not submit PHI beyond administrative data

Doxmate aligns with GDPR and global privacy frameworks where applicable.

15. Termination

We may suspend or terminate access if:

• Terms are violated

• Fraud or misuse is detected

• Payment failures persist

• Meta/WhatsApp blocks your number/WABA

You may cancel anytime per the Refund & Cancellation Policy.

16. Related Policies

These Terms incorporate and reference the following:

• Data Deletion Policy

• Data Processing Agreement (DPA)

• Data Protection & Security Policy

• Refund & Cancellation Policy

Using Doxmate constitutes acceptance of all policies.

17. Force Majeure

We are not responsible for failures or delays caused by events beyond our control, including natural disasters, war, pandemics, government actions, outages, or large-scale cyberattacks.

18. Severability

If any part of these Terms is found unenforceable, the remaining sections remain fully valid.

19. Governing Law

These Terms are governed by the laws of India.
Disputes shall be resolved under the jurisdiction of Bundi, Rajasthan, unless otherwise required by law.
